PRESIDENTIAL Decree No. 1067 na kilala rin bilang Water Code ng Pilipinas. “A decree instituting a Water Code, thereby revising and consolidating the laws governing the ownership, appropriation, utilization, exploitation, development, conservation and protection of water resources.”
WATER AS USED IN THE CODE– Article 4 of the Code provides:
“Water as used in this code, refer to water under the ground, water above the ground, water in the atmosphere and the waters of the sea within the territorial jurisdiction of the Philippines”
1) Sino ang kuwalipikado na magpasa ng application?
a) Filipino citizen
b) Mga Asosasyon, nakarehistong kooperatiba at korporasyon na inorganisa sa ilalim ng batas ng Pilipinas, na may 60% capital na Filipino citizen/s ang may-ari.
c) Government entities and instrumentalities, kasama ang government-owned at controlled corporations (GOCC).
2) Saan magpapasa ng application?
National Water Resources Board (NWRB) office, deputized agent ng probinsya kung saan ang point of diversion ay nakalagay sa kaso ng maling paggamit ng tubig o kung saan ang proyekto ay nakalagay.
Kapag ang ahensya ng gobyerno, GOCC, municipalities, Local Government Unit (LGU’s), barangay, cooperatives, o sinoman gumagamit ng deepwell, kailangang nila makipag-ugnayan sa National Water Resources Board (NWRB).
Base sa ulat mula sa Cebu City reporter, walang water permit ang mga sumusunod:
1. Cebu Municipalities:
Poro, Pilar, Ronda, Sogop, Barili, Tudela, Alegria, Catmon, Carmen, Santa Fe, Borbon, Boljoon, Liloan, Tuburan, Medellin, Santander, Tabuelan, San Francisco, Madrdejos, Ginatilan, Samboan, Malabuyoc, Malabuyoc, Dumanjug, Compostela, Dalaguete, Daanbantayan, Bantayan Island at Aloguinsan.
2. Cebu Cities:
Cebu, Mandaue, Talisay, Lapu-Lapu, Talisay City, Naga City at Carcar City
3. Local Government Unit (LGU), Barangay at Cooepratives.
4. DENR – Region 7
